Business Terms and Conditions
Last updated: 7 August 2026
IMPORTANT NOTICE
These Business Partner Terms and Conditions contain provisions that may:
- Limit the risk or liability of BookMyTable
- Require the Business to assume certain risks or responsibilities
- Require the Business to indemnify BookMyTable or
- Explain the consequences of cancellation, non-payment or termination.
These provisions are presented under clear headings, including Limitation of Liability, Indemnities, Suspension, and Termination. The Business should read them carefully. Nothing in this Agreement excludes any right or remedy that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or other applicable South African law.
1. The parties
This Agreement is between BookMyTable and the Business identified in the applicable registration form, order form or online Account (“Business”).
BookMyTable and the business are individually a “Party” and together the “Parties”.
2. Acceptance and authority
This Agreement governs the business access to and use of the BookMyTable website, Business dashboard, reservation system and related services (“Platform”).
The Business accepts this Agreement by:
- Signing a registration or order form
- Creating or activating a Business Account
- Selecting “I agree” electronically
- Submitting Business Content
- Using the Business dashboard or
- Using any paid or free BookMyTable service.
The person accepting this Agreement on behalf of the Business confirms that:
- They are at least 18 years old
- They are authorised to bind the Business
- The information supplied is accurate
- They have had a reasonable opportunity to read and understand this Agreement.
If the person does not have the required authority, they must not accept this Agreement or use the Business Account.
3. Definitions
In this Agreement:
- “Account” means the Business BookMyTable account and authorised user profiles.
- “Booking Request” means a reservation request requiring approval.
- “Confirmed Reservation” means a reservation recorded as confirmed on the Platform.
- “Diner” means a person using BookMyTable to discover or make a reservation at a Business
- “Fees” means subscription, transaction, communication or other charges accepted by the Business.
- “Order Form” means a signed or electronically accepted registration, package or pricing document.
- “Business Content” means menus, photographs, trademarks, descriptions, prices, promotions, policies and other information supplied by or for the Business.
- “Services” means the BookMyTable services selected by the Business.
- “Subscription Package” means the Discover, Grow or other package selected by the Business.
4. Relationship between the Parties
BookMyTable and the Business are independent contractors. Nothing in this Agreement creates a partnership, employment relationship, franchise, joint venture or general agency between the Parties. BookMyTable provides a technology, discovery and reservation Platform. The Business independently owns or operates its hospitality business and remains responsible for the services supplied to Diners. Neither Party may represent that it has authority to bind the other, except where BookMyTable is expressly authorized to process a booking payment on the Business behalf.
5. BookMyTable Services
Depending on the selected Subscription Package, BookMyTable may provide:
- A Business profile and discovery listing
- Display of menus, photographs and operating hours
- Promotion of specials and Business information
- Online Booking Requests or Confirmed Reservations
- A Business reservation dashboard
- Booking confirmations and reminders
- Table-management functionality
- Walk-in and waiting-list functionality
- Deposit or payment-related functionality
- Reporting and operational statistics
- Communication features and
- Other services described in the Order Form or Platform.
Features may vary between Subscription Packages. BookMyTable does not guarantee that every feature will be available on every device or package.
6. Discover and Grow packages
The Business available features are determined by its selected Subscription Package.
6.1 Discover
The Discover package is primarily intended to provide Business discovery and profile visibility.
Unless otherwise stated in the Order Form, Discover may include:
- A Business listing
- Contact information
- Operating hours
- Menu display
- Business photographs
- Cuisine and location information
- Promotion of Business information.
A Discover listing may be identified as view-only and may not include online reservation functionality.
6.2 Grow
The Grow package may include discovery features together with online reservation and Business-management functionality, as described in the Order Form or current package schedule.
6.3 Package changes
The Business may request an upgrade or downgrade. A package change takes effect on the date confirmed by BookMyTable. Fees and access may be adjusted on a pro-rata basis where stated in the Order Form. A downgrade may result in the loss of features, reports or access to certain historical functions. BookMyTable will provide reasonable notice of any material consequence where practicable.
7. Free promotional or trial periods
BookMyTable may offer free pre-launch promotion, trial periods or introductory discounts.
A free or discounted period:
- Applies only for the period communicated in writing
- Does not permanently change the standard Subscription Fees
- May be subject to reasonable feature restrictions
- May be withdrawn where the Business breaches this Agreement and
- Does not guarantee continued free access after the promotional period.
Before paid billing begins, BookMyTable will communicate the applicable package, price and billing commencement date. The Business will not be charged unless the applicable Fees and payment arrangements have been disclosed and accepted.
8. Business onboarding and verification
The Business must provide accurate and complete onboarding information, which may include:
- Registered or proprietor name
- Trading name
- Registration or identity information;
- Physical address
- Contact details
- Authorized representative details
- Tax or VAT information
- Banking information where payments are enabled
- Licenses and permits
- Business Content.
BookMyTable may take reasonable steps to verify the Business, its representative, banking information or right to use submitted content. BookMyTable may delay activation until reasonably required verification has been completed.
9. Business Account and authorized users
The Business is responsible for:
- Keeping usernames and passwords secure
- Creating separate profiles for authorized staff where available
- Removing access when a staff member leaves or changes role
- Reviewing user permissions
- Preventing unauthorized Account sharing
- Activity performed through the Account and
- Promptly reporting suspected unauthorized access.
BookMyTable is not responsible for unauthorized activity caused by the Business failure to secure its Account, except to the extent that the activity resulted from BookMyTable’s own breach of its legal obligations.
10. Business listing and Content
The Business must ensure that its listing is accurate, current and not misleading.
This includes:
- Business name and location
- Contact information
- Operating hours
- Menus and prices
- Cuisine and facility descriptions
- Accessibility information
- Photographs
- Promotions
- Reservation availability
- Deposit and cancellation policies
- Alcohol, age or other restrictions.
The Business must promptly correct outdated or inaccurate information. BookMyTable may assist with uploading or formatting Business Content, but the Business remains responsible for reviewing and approving its accuracy. BookMyTable may reject, remove or request changes to content that is unlawful, misleading, technically harmful, poor quality or inconsistent with Platform standards.
11. License to use Business Content
The Business retains ownership of its Business Content.
The Business grants BookMyTable a non-exclusive, royalty-free, worldwide license to:
- Host, store and reproduce Business Content
- Format and display it on the Platform
- Use it to operate the Services
- Promote the Establishment and BookMyTable
- Display it in search results and marketing campaigns and
- Adapt its size or format for technical purposes.
This license continues for the term of the Agreement and for a reasonable period afterwards where necessary to remove cached, scheduled or archived material.
The Business confirms that:
- It owns the Business Content or has permission to use it
- BookMyTable’s permitted use will not infringe another person’s rights
- It has obtained any necessary permission from people appearing in submitted photographs
12. BookMyTable intellectual property
BookMyTable owns or licenses the Platform, software, database structure, branding, designs, documentation and related intellectual property. The Business receives a limited, non-exclusive, non-transferable and revocable right to use the Services during the Agreement.
The Business may not:
- Copy or reverse-engineer the Platform
- Circumvent access or security controls
- Resell or sublicense the Services
- Scrape or extract Platform data without permission
- Use BookMyTable branding without approval
- Build a competing service by copying protected Platform elements or
- Help another person engage in prohibited conduct.
Nothing prevents the Establishment from operating its business, using another provider or developing independent systems that do not infringe BookMyTable’s rights.
13. Business availability and reservation settings
The Business must keep the following information accurate:
- Available dates and times
- Table capacity
- Party-size limits
- Booking intervals
- Table-holding periods
- Closure dates
- Special-event availability
- Deposit requirements and
- Booking or cancellation policies.
The Business is responsible for reviewing its settings and reservations regularly. If BookMyTable assists with configuration, the Business must verify the completed settings before relying on them. BookMyTable is not responsible for overbooking or lost availability caused by inaccurate Business settings, except where directly caused by a proven Platform error under BookMyTable’s control.
14. Booking requests and confirmed reservations
The Business must clearly select whether reservations are:
- Confirmed instantly
- Submitted as Booking Requests requiring Business approval.
The Business must respond to Booking Requests within a reasonable period. The Business must honor Confirmed Reservations unless prevented by circumstances outside its reasonable control.
If the Business cannot honor a Confirmed Reservation, it must:
- Notify the Diner promptly
- Explain the cancellation
- Process any refund legally due
- Update the reservation status and
- Make reasonable efforts to offer an alternative where appropriate.
The Business must not alter reservation statuses to prevent a Diner from receiving legitimate communications or submitting an eligible review.
15. Diner service and Business responsibility
The contract for food, beverages and Diners service is between the Food Establishment and the Diner.
The Business is solely responsible for:
- Food preparation, quality and safety
- Service at its premises
- Health and safety
- Hygiene
- Allergens and ingredient information
- Alcohol service
- Accessibility information
- Staff conduct
- Menu pricing
- Taxes and receipts
- Promotions
- Legal compliance and
- Complaints concerning the dining experience.
BookMyTable does not prepare, supply or serve food and does not control the Business operations.
16. Special requests and dietary information
The Platform may transmit dietary, allergy, accessibility or special-occasion requests to the Business.
The Business must:
- Limit access to authorized staff
- Use the information only for the reservation and related service
- Keep the information confidential
- Avoid making guarantees it cannot meet
- Communicate directly with the Diner where clarification is necessary and
- Handle health-related information according to POPIA.
BookMyTable does not guarantee that the Business can accommodate a request. The Business remains responsible for communicating allergen and cross-contamination risks to the Diner.
17. Deposits, cancellation policies and refunds
Where deposit functionality is available, the Business must maintain an accurate and lawful cancellation and refund policy.
The policy must clearly state:
- The deposit or prepayment amount
- The cancellation deadline
- Any no-show or cancellation charge
- When a refund will be available
- Whether any disclosed fee is non-refundable and
- How a refund may be requested.
The Business must ensure that cancellation and no-show charges are reasonable and permitted by applicable law.
Refund decisions relating to Diners deposits or prepaid Diners services are made by the Business and not by BookMyTable, subject to applicable law.
The Business must respond promptly to refund requests. Where a refund is legally due or approved by the Business, the Business must provide any instruction or funding reasonably required to process it. BookMyTable may assist with communication or technical processing but is not responsible for the Business refund decision. Once processed, a refund may take between 5 and 10 business days to reflect, depending on the payment provider and the Diner’s financial institution.
18. Payment-processing services
This section applies only where BookMyTable has activated payment-processing functionality for the Business. BookMyTable may use an authorized third-party payment provider to process deposits or other Business payments.
The Business agrees to:
- Complete required identity, business and banking verification
- Provide accurate settlement details
- Comply with payment-provider rules
- Maintain sufficient funds for refunds and chargebacks
- Supply supporting documents for disputed payments
- Pay disclosed transaction, settlement and chargeback fees and
- Notify BookMyTable immediately of suspected payment fraud.
BookMyTable may delay or withhold settlement where reasonably necessary because of:
- A refund obligation
- A chargeback
- Suspected fraud
- Incorrect banking information
- A legal or regulatory requirement
- A payment-provider instruction or
- An unresolved ownership or authority dispute.
Detailed settlement timing, fees and payment-provider terms must be stated in a separate Payment Services Schedule or Order Form before payment functionality is activated.
19. Chargebacks and payment disputes
If a Diner disputes a payment, the Business must provide supporting evidence within the required period. The Business is responsible for a chargeback where the payment is reversed because:
- The Business did not provide the service.
- The payment was unauthorized.
- The Business cancellation policy was unclear or unlawful.
- The Business failed to respond with evidence.
- A refund was due but not processed.
- The payment provider or bank validly reverses the transaction.
BookMyTable may deduct a valid chargeback and associated disclosed fees from future settlements or invoice the Business where lawful. BookMyTable will provide available transaction information and reasonable technical assistance but does not control a bank or card provider’s final chargeback decision.
20. Subscription Fees and Invoices
The Business must pay the Fees stated in the accepted Order Form or package schedule.
Unless stated otherwise:
- Subscription Fees are billed in advance
- Prices exclude VAT where applicable
- Invoices are payable by the stated due date
- Transaction and communication charges may be billed separately and
- Third-party charges may apply to optional services.
BookMyTable may correct an obvious billing error and will provide supporting information on request. The Business must dispute an invoice in writing within 5 working days of receipt, explaining the disputed amount. Undisputed amounts remain payable.
21. Fee changes
BookMyTable may change Subscription Fees by giving at least 30 days’ written notice. If the Business does not accept a material increase, it may terminate the affected paid Service before the increase takes effect, subject to any lawful minimum term expressly agreed in the Order Form. Continued use after the effective date constitutes acceptance where the Business received reasonable notice and had an opportunity to cancel.
Price changes do not apply retrospectively.
22. Non-payment
If an undisputed amount remains unpaid after its due date, BookMyTable may:
- Send payment reminders;
- Restrict paid features
- Suspend reservation functionality
- Downgrade the listing where appropriate
- Charge lawful interest disclosed in advance; or
- Terminate the affected Service after reasonable notice.
Where reasonably possible, BookMyTable will provide at least seven days to remedy non-payment before suspending a material feature. Suspension does not cancel amounts already due. BookMyTable must take reasonable steps to prevent existing Diners from being unfairly affected by the suspension.
23. Personal information and POPIA
Each Party must comply with POPIA and other applicable privacy law.
The Parties acknowledge that their privacy roles may differ according to the processing activity:
- BookMyTable may act as a responsible party for Account, Platform, security, analytics and direct BookMyTable customer relationships
- A Business may act as a responsible party for its dining services, customer relationships and independent marketing
- Either Party may act as an operator when processing information only on the documented instructions of the other and
- The Parties may act as separate responsible parties for certain reservation activities.
Neither Party may use personal information merely because it is technically accessible.
24. Business use of Diner information
The Business may access information reasonably necessary to manage a reservation, such as:
- Diner name
- Contact information
- Reservation date and time
- Party size
- Booking status
- Special requests
- Dietary or accessibility information and
- Deposit status.
The Business must:
- Use the information only for lawful purposes
- Restrict access to authorized personnel
- Keep information secure and confidential
- Maintain accurate information
- Avoid excessive copying or exporting
- Respond appropriately to data-subject requests
- Retain information only as long as legally justified
- Securely delete or destroy information when no longer required and
- Notify BookMyTable promptly of suspected unauthorized access involving Platform data.
The Business must not sell Diner information or provide it to an unauthorized third party.
25. Direct marketing
Reservation details may be used to provide reservation and dining services. The Business may not use Diner information for unrelated email, SMS, telephone or WhatsApp marketing unless it has a lawful basis and complies with POPIA and other applicable marketing laws.
Where consent is required:
- It must be obtained properly
- It must not be assumed from a reservation
- The marketing sender must be identified
- An easy and free opt-out must be provided and
- Opt-outs must be honored promptly.
BookMyTable is not responsible for independent marketing sent by the Business.
26. Information-security incidents
Each Party must implement reasonable and appropriate security safeguards. A Business must notify BookMyTable without undue delay if it reasonably suspects that Diner or Platform information has been:
- Lost
- Accessed without authority
- Disclosed unlawfully
- Altered
- Destroyed
- Compromised.
The Business must preserve relevant evidence and reasonably cooperate with investigation, containment and legally required notifications. Neither Party may notify the public on behalf of the other without coordination, unless required by law.
27. Reviews
Where reviews are enabled, the Business agrees that:
- Both positive and negative compliant reviews may be published
- A review will not be removed merely because it is negative
- The Business may report content that breaches the Review Policy
- Reporting does not guarantee removal
- The Business must not submit fake reviews
- The Business must not pressure Diners for positive ratings
- The Business must not offer benefits only for positive reviews
- The Business must not retaliate against a reviewer and
- Any public response must comply with the Review Policy.
BookMyTable may moderate reviews according to its published Review Policy. BookMyTable does not guarantee that every review is accurate or that every review will be checked before publication.
28. Business legal compliance
The Business confirms that it holds and will maintain all registrations, permits and licenses required to operate lawfully.
The Business is responsible for compliance relating to:
- Food safety and hygiene
- Liquor licensing
- Employment
- Health and safety
- Fire and occupancy requirements
- Consumer protection
- Pricing and advertising
- Taxes
- Music or entertainment licensing
- Accessibility
- Privacy and direct marketing
- Any other law applicable to its operation.
BookMyTable may request reasonable evidence of compliance where a legitimate concern arises.
29. Platform availability and support
BookMyTable will take reasonable steps to provide a secure and reliable Platform. The Establishment acknowledges that availability may be affected by:
- Maintenance
- Internet or telecommunications failures
- Hosting or payment-provider interruptions
- Load shedding
- Cybersecurity incidents
- Software updates
- Events outside BookMyTable’s reasonable control.
BookMyTable does not guarantee uninterrupted or error-free availability. Support requests may be submitted to support@bookmytable.co.za. Any guaranteed service level must be expressly stated in a separate written service-level agreement.
30. Changes to the Services
BookMyTable may improve, modify or discontinue features.
BookMyTable will provide reasonable advance notice where a change materially reduces a paid core feature, unless urgent action is required for:
- Security
- Legal compliance
- Fraud prevention
- Third-party service failure or
- Protection of Users or the Platform.
If a permanent change materially removes the principal purpose of a paid package, the Business may terminate the affected Service before the change takes effect.
31. Suspension
BookMyTable may immediately restrict or suspend the Business access where reasonably necessary because of:
- Fraud or suspected fraud
- A serious security risk
- Unlawful activity
- Material harm to a Diner or the Platform
- Repeated failure to honor Confirmed Reservations
- Misuse of Diner information
- Review manipulation
- A legal or payment-provider instruction or
- A material breach requiring urgent action.
Where the issue is capable of remedy and does not require urgent suspension, BookMyTable will ordinarily give the Business reasonable notice and an opportunity to correct it. BookMyTable will limit a suspension to what is reasonably necessary.
32. Term and termination
This Agreement begins when accepted and continues until terminated. Unless the Order Form contains a valid agreed minimum term, either Party may terminate without cause by giving one calendar month’s written notice.
Either Party may terminate immediately if the other Party:
- Commits a material breach and fails to remedy it within seven days after written notice
- Commits a breach that cannot reasonably be remedied
- Becomes insolvent or enters formal liquidation or business-rescue proceedings
- Engages in fraud or unlawful conduct or
- Creates a serious safety, privacy or reputational risk.
Termination does not remove rights or amounts that accrued before termination.
33. Consequences of termination
On termination:
- The Business paid access will end on the effective termination date
- The listing may be removed, downgraded or marked unavailable
- Outstanding Fees become payable
- Existing reservations must be handled fairly
- The Food Business remains responsible for approved refunds and chargebacks
- Each Party must stop using the other Party’s intellectual property
- Personal information must be retained, returned or deleted according to applicable law and the Parties’ privacy roles and
- Provisions intended to survive termination remain effective.
On written request, BookMyTable will make a reasonable export of Business-supplied data available where technically possible, lawful and included in the applicable package. BookMyTable is not required to provide its proprietary analytics, algorithms, aggregated data or confidential system information.
34. Prepaid Subscription Fees
The treatment of prepaid Subscription Fees must comply with the Order Form and applicable law. Where the Business terminates for convenience during a prepaid period, unused Fees may be non-refundable if this was clearly disclosed and is lawful. Where BookMyTable terminates without Business fault or permanently discontinues a prepaid core Service, BookMyTable will provide an appropriate pro-rata refund or service credit unless another lawful arrangement is agreed.
35. Business warranties
The Business warrants that:
- It has authority to enter into this Agreement
- Its onboarding information is accurate
- Its Business Content is lawful and authorized
- It will keep booking settings current
- It will provide Business services with reasonable care and skill
- It will comply with applicable law
- It will not misuse Diner information
- It will not manipulate reviews or reservations and
- It will not use the Platform for fraudulent or unlawful activity.
36. BookMyTable warranties
BookMyTable warrants that:
- It has authority to enter into this Agreement
- It may lawfully provide the Platform
- It will provide the Services with reasonable care and skill
- It will maintain reasonable information-security measures and
- It will comply with applicable law governing its Services.
Except for express warranties and rights that cannot lawfully be excluded, BookMyTable does not guarantee:
- A particular number of views or reservations
- Increased revenue
- Search-engine ranking
- Diner attendance
- Business profitability
- A specific review score or
- Continuous Platform availability.
37. Limitation of Liability
This section limits BookMyTable’s potential liability and must be read carefully.
BookMyTable is not responsible for:
- A Diner’s failure to attend a reservation
- Food Business, beverages, premises or service
- Incorrect Business Content
- Business overbooking caused by inaccurate settings
- A Business failure to honor a reservation;
- A Business refund decision
- Unauthorized Account activity caused by the Business security failure
- Indirect or consequential loss or
- Loss caused by a third-party service outside BookMyTable’s reasonable control.
Neither Party is liable to the other for indirect, incidental, special or consequential loss, including loss of anticipated profit, except where such exclusion is unlawful. Subject to applicable law, BookMyTable’s total aggregate liability arising from the paid Services during a 12-month period will not exceed the Fees paid by the Business during the six months immediately preceding the event giving rise to the claim.
The liability cap does not apply to the extent that liability results from:
- Fraud
- Intentional misconduct
- Gross negligence where it cannot lawfully be limited
- Infringement of the other Party’s intellectual property
- Unlawful misuse of personal information or
- An obligation that cannot lawfully be limited.
38. Indemnities
Each Party indemnifies the other against a third-party claim arising directly from the indemnifying Party’s:
- Material breach of this Agreement
- Fraud or intentional misconduct
- Unlawful processing of personal information
- Infringement of intellectual-property rights or
- Failure to comply with applicable law.
The Business additionally indemnifies BookMyTable against a third-party claim arising from:
- Food or beverages supplied by the Business
- Conditions at the Business premises
- Business Content
- Business marketing
- A Business refund decision
- Business staff conduct
- The Business failure to honor its obligations to a Diner.
The indemnified Party must:
- Notify the indemnifying Party promptly
- Provide reasonable cooperation
- Allow the indemnifying Party reasonable control of the defense and
- Not agree to a settlement imposing liability on the indemnifying Party without consent.
An indemnity does not apply to the extent that the claim was caused by the indemnified Party’s own unlawful conduct, negligence or breach.
39. Force majeure
Neither Party is liable for delay or failure caused by an event beyond its reasonable control, including natural disasters, epidemic, war, civil unrest, strikes, telecommunications failure, widespread power failure, government action or major cybersecurity incidents not caused by that Party’s failure to take reasonable precautions.
The affected Party must:
- Notify the other Party where reasonably possible
- Take reasonable steps to reduce the impact and
- Resume performance when reasonably possible.
Payment obligations already incurred are not automatically cancelled by force majeure.
40. Changes to this Agreement
BookMyTable may update this Agreement for operational, security or legal reasons. BookMyTable will provide at least 30 days’ notice of a material change, unless a shorter period is reasonably necessary for legal compliance or urgent security protection. A material change will not retrospectively alter an existing payment or accrued right. If the Business reasonably objects to a material change that substantially disadvantages it, the Business may terminate the affected Service before the change becomes effective.
41. Notices
Formal notices must be sent to:
- The Business registered physical or email address; and
- BookMyTable at info@bookmytable.co.za or its registered address.
A Party must keep its contact information current.
An email notice is treated as received on the next business day unless the sender receives a delivery-failure notification.
42. Complaints and dispute resolution
A Business should first submit a complaint to info@bookmytable.co.za. The Parties will attempt in good faith to resolve the dispute through direct discussion. If the dispute is not resolved, either Party may propose mediation before commencing court proceedings. Mediation is voluntary unless separately agreed. Nothing prevents a Party from seeking urgent court relief or using another legally available forum.
43. Governing law and jurisdiction
This Agreement is governed by the laws of the Republic of South Africa. The Parties consent to the jurisdiction of a competent South African court, subject to any right to approach another legally entitled tribunal, regulator or forum.
44. Assignment
The Business may not transfer this Agreement without BookMyTable’s prior written consent, which will not be unreasonably withheld. BookMyTable may transfer the Agreement as part of a lawful merger, sale, restructuring or transfer of the Platform, provided that the Business’s rights are not unlawfully reduced.
45. General provisions
45.1 Entire agreement
This Agreement, the accepted Order Form, package schedule, Privacy Policy, Review Policy and any applicable Payment Services Schedule form the agreement between the Parties concerning the Services.
If there is a conflict, the following order applies:
- A specifically negotiated and signed agreement
- The Order Form or Payment Services Schedule
- These Business Partner Terms and Conditions
- General Platform policies.
45.2 Amendments
A special amendment must be recorded in writing and accepted by authorized representatives of both Parties.
45.3 No waiver
A failure or delay in enforcing a right does not waive that right.
45.4 Severability
If a provision is unlawful or unenforceable, it will be limited or removed only to the extent necessary. The remaining provisions continue to apply.
45.5 No third-party rights
Except where expressly stated, this Agreement does not give contractual rights to a third party.
45.6 Electronic acceptance
The Parties agree that this Agreement and related notices may be accepted, signed, delivered and retained electronically.
