6. BookMyTable’s role

BookMyTable acts as a technology intermediary between Diners and independent Business. The contract for food, beverages, premises and dining services is between you and the Business.

BookMyTable does not:

  • Own or operate Business
  • Prepare, handle or serve food
  • Employ Diner staff
  • Control Business premises
  • Determine menus or Business prices
  • Decide whether a Business can accommodate an allergy
  • Guarantee Business  service
  • Determine whether a Business approves a refund or
  • Control a Business day-to-day operations.

BookMyTable remains responsible for providing its own Platform services with reasonable care and skill and for obligations that applicable law places directly on BookMyTable.

7. Eligibility

You must be at least 18 years old and legally capable of contracting to:

  • Create an Account independently
  • Make a reservation involving a deposit
  • Accept a cancellation or no-show fee or
  • Enter into another financial obligation.

A person under 18 may use the Platform only under the active supervision of a parent or legal guardian.

8. Account security

You agree to:

  • Provide accurate information
  • Keep your contact details current
  • Keep your login credentials confidential
  • Prevent unauthorized access
  • Use separate Accounts where appropriate and
  • Notify BookMyTable promptly of suspected unauthorized activity.

You may not impersonate another person, create false Accounts, sell an Account or use multiple Accounts to avoid restrictions. You are not responsible for unauthorized activity caused by BookMyTable’s failure to meet its own security or legal obligations.

9. Business listing types

A Business may:

  • Accept instantly confirmed reservations
  • Accept Booking Requests requiring approval
  • Be temporarily unavailable for online bookings
  • Be listed for discovery and viewing only.

A view-only listing does not accept online bookings through BookMyTable. You must check the displayed booking status before relying on a listing.

10. Business information

Business Content is generally provided by the Business Establishment.

BookMyTable does not guarantee the continued accuracy or availability of:

  • Menus and prices
  • Operating hours
  • Promotions
  • Photographs
  • Facilities
  • Accessibility information
  • Cuisine descriptions
  • Particular meals
  • Seating arrangements or
  • Business availability.

BookMyTable may correct or remove content when it becomes aware that it is inaccurate, unlawful or misleading. Where information is important to your decision, confirm it directly with the Business.

11. Making a reservation

You must provide accurate:

  • Contact information
  • Reservation date and time
  • Number of guests
  • Special requests and
  • Payment details where required.

Before submitting a reservation, review:

  • The Business
  • Date and time
  • Party size
  • Booking status
  • Deposit amount
  • Cancellation deadline
  • No-show conditions and
  • Business-specific terms.

You may not create fraudulent, duplicate or speculative reservations or reserve tables for resale.

12. Booking Requests

A Booking Request is not a Confirmed Reservation. A notice acknowledging receipt only confirms that the request was received.

You must not treat the reservation as confirmed until:

  • The Platform displays a confirmed status
  • You receive an express confirmation from BookMyTable or the Business.

BookMyTable is not responsible for a User treating an unconfirmed request as confirmed where the status was displayed accurately.

13. Confirmed Reservations

You are responsible for checking the confirmation details before travelling to the Business. If communications contain conflicting information, contact the Business or BookMyTable support. A Confirmed Reservation does not guarantee a particular table, seating area, dish or special arrangement unless the Business expressly confirms it.

14. Group reservations

If you book for other people, you confirm that you have permission to provide the information reasonably required for the reservation.

You must:

  • Provide the correct number of guests
  • Communicate relevant booking conditions to the group
  • Obtain permission before submitting another person’s sensitive information and
  • Ensure that your group complies with reasonable Business policies.

15. Allergies, dietary requirements and accessibility

BookMyTable may transmit dietary, allergy, accessibility or special requests to the Business. BookMyTable does not guarantee that the Business can accommodate a request. If you have a serious allergy, medical dietary requirement or accessibility need, contact the Business directly before visiting. Because BookMyTable does not prepare or serve food, it cannot guarantee:

  • Ingredient accuracy
  • Absence of allergens
  • Prevention of cross-contamination or
  • Business compliance with a special request.

16. Free Diner access

BookMyTable does not charge Diners a general fee merely to:

  • Search for the Business
  • View Business  listings
  • Make an ordinary reservation.

A Business may require a separately disclosed deposit, prepayment, cancellation fee or no-show fee.

17. Deposits and other charges

A Business may require:

  • A reservation deposit
  • Prepayment
  • A cancellation fee or
  • A no-show fee.

The amount, deadline and applicable policy must be displayed before you complete the reservation. A Business may only impose a cancellation or no-show fee where:

  • It was clearly disclosed
  • You accepted the policy
  • The fee is reasonable in the circumstances and
  • The fee is permitted by applicable law.

Where BookMyTable facilitates payment:

  • Payment may be processed by an independent payment provider
  • BookMyTable may act as a technical facilitator or collection agent for the Business
  • The amount remains connected to the Business underlying service
  • You must provide a valid and authorized payment method and
  • You authorize the disclosed amount to be charged according to the accepted policy.

The payment or checkout screen forms part of the transaction record.

18. Payment processing

BookMyTable and its payment provider are responsible for taking reasonable steps to process payment instructions accurately and securely. BookMyTable does not guarantee that every payment will be authorized or completed. A payment may be declined or delayed because of:

  • Your bank
  • The payment provider
  • Fraud-prevention checks
  • Incorrect payment information
  • Technical interruptions or
  • Legal or regulatory requirements.

BookMyTable is not responsible for a payment-provider or financial-institution failure outside its reasonable control, but will provide reasonable technical assistance where appropriate.

19. Cancellations and modifications

You may cancel or modify an eligible reservation through the Platform, subject to:

  • The Business disclosed policy
  • The cancellation deadline
  • Availability
  • Any reasonable and lawful charge accepted during booking.

A requested modification is not effective until confirmed. If online cancellation is unavailable, contact the Business directly and retain evidence of the communication. Closing your Account does not automatically cancel an existing reservation.

20. Business cancellations and refunds

If a Business cancels a prepaid reservation or cannot provide the reserved service, any refund legally due will be handled according to the Business policy and applicable law.

The Business determines whether it approves a refund relating to its deposit or prepaid dining service, subject to applicable law. BookMyTable does not make the Business commercial refund decision.

For refund requests or policy questions, contact the Business directly. Where BookMyTable or its payment provider technically processes the refund:

  • The Business must first approve or lawfully instruct the refund
  • BookMyTable will take reasonable steps to process a valid instruction accurately
  • BookMyTable may request information needed to identify the transaction and
  • BookMyTable remains responsible for its own proven processing errors.

Once processed, a refund may take between 5 and 10 business days to reflect, depending on the payment provider and your financial institution. A transaction or administration fee will only be non-refundable where this was clearly disclosed before payment and is permitted by law. If the Business does not respond or you believe a legally required refund has been refused, you may contact support@bookmytable.co.za for assistance. This does not make BookMyTable the supplier of the Business dining service.

21. Late arrivals

If you expect to arrive late, contact the Business directly.

A Business may release the table:

  • After its disclosed holding period
  • Where you do not notify it of a delay
  • After a reasonable period where no holding period was disclosed.

BookMyTable is not responsible where the Business reasonably releases a table according to a disclosed policy.

22. No-shows

A Business may impose a disclosed and reasonable no-show fee where permitted by law.

Repeated no-shows may result in:

  • A warning
  • Deposit requirements
  • Booking restrictions
  • Temporary suspension
  • Account termination in serious cases.

Before imposing a material Account restriction, BookMyTable may consider information supplied by both the Diner and  the Business.

23. Waiting lists

A waiting-list position or estimated waiting time is not a Confirmed Reservation. Waiting times may change due to the Business operations, party size, table availability or other circumstances.

24. Service communications

BookMyTable may send operational communications concerning:

  • Booking requests
  • Confirmations
  • Reminders
  • Changes
  • Cancellations
  • Deposits
  • Refund status
  • Waiting lists
  • Account security and
  • Important Platform updates.

These may be sent by email, SMS, WhatsApp, push notification or through the Platform.

These messages are not necessarily marketing.

25. Marketing

Marketing consent will be requested separately where required. You may unsubscribe from marketing without losing access to essential reservation and security communications. A reservation does not automatically authorize  a Restaurant to send unrelated marketing.

26. Reviews

Eligible reviews must comply with the BookMyTable Review Policy.

A review must:

  • Reflect a genuine experience
  • Be truthful and relevant
  • Distinguish opinion from fact
  • Avoid abusive or unlawful content
  • Protect personal information
  • Disclose incentives or complimentary experiences
  • Avoid conflicts of interest.

BookMyTable may publish positive and negative compliant reviews. A review will not be removed merely because a Business disagrees with it. BookMyTable may investigate, restrict or remove a review that breaches the Review Policy, these Terms or applicable law.

27. User Content

You retain ownership of User Content.

By submitting it, you grant BookMyTable a non-exclusive, worldwide, royalty-free licence to host, store, format, reproduce, display and moderate it for operating and promoting the Platform.

You confirm that:

  • You own the content or have permission to use it
  • It does not infringe another person’s rights and
  • You have permission to submit identifiable photographs.

28. Acceptable use

You may not:

  • Provide false or misleading information
  • Create fraudulent reservations
  • Manipulate reviews or ratings
  • Access another Account without authority
  • Use automated tools without permission
  • Scrape Platform data
  • Circumvent security controls
  • Introduce malicious code
  • Resell reservations
  • Use the Platform unlawfully.

BookMyTable may investigate suspected misuse and take proportionate action.

29. Intellectual property

The Platform, software, branding, design, text, graphics and database structure are owned by or licensed to BookMyTable. Business names, logos, menus and photographs may belong to the relevant Business. You receive a limited right to use the Platform for lawful, personal and non-commercial purposes. You may not copy, resell, reverse-engineer or commercially exploit the Platform without permission.

30. Privacy

BookMyTable processes personal information according to its Privacy Policy and POPIA. Relevant reservation information will be shared with the selected Business  to manage your reservation. BookMyTable remains responsible for personal information where it acts as a responsible party and for security and processing obligations placed directly on it by law.

Business may act as separate responsible parties for their independent dining services and customer relationships.

31. Location services

If you grant permission, BookMyTable may process device location to display nearby Business or personalise search results. You may withdraw location permission through your device or browser settings. Location information may be approximate and must not be relied upon for emergency or safety purposes.

32. Third-party services

The Platform may link to Business websites, maps, payment providers or social-media platforms. These services operate independently and may have their own terms and privacy policies. BookMyTable is not responsible for independent third-party conduct outside its reasonable control.

33. Platform availability

BookMyTable takes reasonable steps to provide a secure and reliable Platform but does not guarantee uninterrupted or error-free access. Availability may be affected by maintenance, telecommunications failures, hosting interruptions, load shedding, cybersecurity incidents or events outside BookMyTable’s reasonable control.

BookMyTable will take reasonable steps to restore affected Services and remains responsible where an interruption was caused by its failure to exercise reasonable care.

34. Account restriction and termination

BookMyTable may restrict or terminate an Account because of:

  • Fraud
  • Security risks
  • Repeated no-shows
  • Harassment
  • Review manipulation
  • Unlawful activity
  • Material breaches
  • Conduct creating a material risk to others.

Where reasonably possible, BookMyTable will:

  • Explain the reason
  • Allow you to respond and
  • Limit the restriction to what is reasonably necessary.

Account closure does not automatically cancel reservations, remove amounts already due or delete records that must lawfully be retained.

35. Diner responsibilities

You are responsible for:

  • Providing correct booking information
  • Reviewing confirmation details
  • Arriving on time
  • Cancelling within the accepted period
  • Contacting the Business about serious dietary needs
  • Paying disclosed and lawful charges
  • Protecting your Account and
  • Behaving lawfully and respectfully.

BookMyTable is not responsible for loss directly caused by inaccurate information supplied by you or your failure to review clearly disclosed conditions.

36. Business responsibility

The Business is independently responsible for:

  • Food and beverage preparation

  • Business refund decisions.

A claim concerning these matters should ordinarily be directed to the Business. BookMyTable may assist with communication but does not assume the Business operational responsibilities by doing so.
